Venmo Accused of Sharing Private User Data Without Consent

A lawsuit has been filed against PayPal, operating as Venmo, alleging that the company shared private user data with third parties without obtaining user consent. According to the complaint, Venmo users were led to believe their transaction information would remain private, but third-party tracking technologies allegedly intercepted and recorded their data.

The lawsuit claims that Venmo embedded tracking technologies from companies such as mParticle and Kochava, allowing these third parties to access users’ financial transaction data. This data reportedly included the sender’s full name, email address, phone number, advertising ID, the recipient’s identity, the amount paid, and transaction notes. Plaintiffs argue that the information was neither anonymous nor aggregated, contradicting Venmo’s privacy promises.

Plaintiffs believe consumers were harmed because they were misled by Venmo’s privacy statements and marketing materials, which assured users of data security. They argue that PayPal’s actions resulted in an invasion of privacy and unjust enrichment, as users’ personally identifiable information was disclosed without their consent.

The complaint seeks to represent a nationwide class of all U.S. residents who used Venmo with privacy settings set to private or who conducted at least one private transaction. Plaintiffs are requesting damages, fees, and costs, as well as a jury trial, for alleged violations of several privacy laws, including the Gramm-Leach-Bliley Act and various California state laws.
