Unisom Sleep Aid Class Action Investigation

A lawsuit has been filed against the makers of Unisom alleging that certain sleep aid products were falsely marketed as “non-habit forming.” According to the complaint, the products contain diphenhydramine, an active ingredient that Plaintiffs claim can lead to dependence and withdrawal symptoms with prolonged use.

Plaintiffs allege that the “non-habit forming” claim was prominently displayed on the product packaging and influenced consumers to purchase the medication over competing sleep aids. The lawsuit argues that consumers paid a premium believing the product would not carry the risk of dependence associated with long-term use.

The complaint further alleges that the manufacturers knew consumers frequently use over-the-counter sleep aids for extended periods, increasing the potential risk of habitual use. Plaintiffs claim that the labeling failed to accurately disclose these risks and violated consumer protection and warranty laws.

The lawsuit seeks to represent consumers who purchased Unisom sleep aid products containing diphenhydramine during the applicable class period. Plaintiffs are seeking damages, restitution, and changes to the product’s labeling and marketing practices.

Because the allegations involve a widely distributed over-the-counter medication and claims of deceptive marketing regarding its potential for dependence, a class action lawsuit may follow or expand as more consumers become aware of the issue.
