A lawsuit has been filed against Thermos alleging that the company sold food jars and beverage bottles with a defective stopper. According to the complaint, the stopper lacks a proper pressure-relief mechanism, which can cause pressure to build up inside the container.
Plaintiffs claim that the defective stopper can eject with significant force, potentially causing injuries such as impact injuries, lacerations, and eye damage. The lawsuits highlight that Thermos marketed the stoppers as having a ‘Dura-Guard pressure relief stopper,’ which was supposed to enhance performance and remove easily.
Plaintiffs argue that consumers were harmed by purchasing products that were unsafe and allegedly worthless due to the defect. They claim they would not have bought the Thermos products, or would have paid less, had they been aware of the stopper risk.
The complaint seeks to represent a nationwide class and three state subclasses. The plaintiffs are requesting damages and argue that the recall remedy offered by Thermos was inadequate, as it did not include a cash refund and placed the burden on consumers to manage the return process.
