Sunny Delight Beverages Co. falsely advertises its alcoholic Sunny D Vodka Seltzer beverage as containing “0g sugar” even though it contains approximately 2 grams of sugar, according to recent analysis.
It is also asserted that Sunny D Vodka Seltzer is sweetened with fruit juice, and the calories from fruit juice are mostly sugar. Out of the total 95 calories displayed on the label, 87 calories come from alcohol which leaves 8 calories arguably resulting from the use of fruit juice.
Many hard seltzer brands have claims of “no sugar added” but this does not necessarily translate to 0g of sugar in the final product. Alcohols like vodka do contain calories but the calories are not from sugar since fermentation and distillation removes excess sugars.
The allegedly false “0g sugar” label violates California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act.
