Southwest Airlines False Sales Class Action Lawsuit

A class-action lawsuit has been filed against Southwest Airlines in Washington federal court. Plaintiffs allege that the airline sent emails with misleading subject lines, designed to trick recipients into opening them and making purchases.

At the center of the complaint are subject lines such as “Last Day,” which implied a sale’s imminent end—only for the sale to be extended, suggesting Southwest never intended for the offer to be short-lived. Plaintiffs claim this reflects a pattern of falsely advertised “sale extensions.”

The lawsuit argues that Southwest’s messages violated both the Washington Commercial Electronic Mail Act and the Washington Consumer Protection Act. Plaintiffs seek to represent a nationwide class of consumers who received emails containing subject lines falsely suggesting exclusivity, early access, or time-limited offers that did not align with actual sale practices.

The proposed class includes those who were told sales were starting when already available, offered early access when no such exclusivity existed, or informed a sale was ending when it would continue beyond the advertised timeframe. The complaint requests a jury trial, along with declaratory and injunctive relief and statutory and treble damages.
