PayByPhone Parking Class Action Lawsuit

A lawsuit has been filed against PayByPhone, alleging that the company’s parking meter mobile app begins charging users for parking time before they actually complete payment. According to the complaint, the app may start a parking session in the background as soon as a user selects a parking duration, even if they have not yet confirmed the transaction or pressed the final payment button.

Plaintiffs claim this design differs from traditional parking meters, where the timer only begins after payment has been successfully processed. The lawsuit argues that users may unknowingly lose part of their purchased parking time while still navigating the payment screen, effectively reducing the value of the parking they paid for.

The complaint was filed in federal court in California and alleges that PayByPhone’s practices may violate consumer protection laws by failing to clearly disclose when the parking timer begins. Plaintiffs argue that reasonable users expect the countdown to start only after payment is finalized.
