Costco Orgain Protein Powder Class Action Lawsuit
A lawsuit has been filed against Costco alleging that certain Orgain Organic Protein Powder products sold through its stores and website contain undisclosed heavy metals, including lead, cadmium, and arsenic. According to the complaint, Costco marketed the products as “clean,” “high quality,” and made with quality ingredients without informing consumers about the alleged presence of these contaminants.
Plaintiffs claim they purchased Orgain Organic Protein Powder in the Vanilla Bean and Creamy Chocolate Fudge varieties from Costco locations and Costco.com. The lawsuit alleges that consumers relied on Costco’s marketing and paid a premium for what they believed to be a clean and nutritious product, unaware of the alleged heavy metal contamination.
The complaint references independent laboratory testing that allegedly detected measurable levels of lead, cadmium, and arsenic in the products. Plaintiffs argue that Costco knew or should have known about the alleged contamination through its quality control and supplier oversight processes but failed to disclose the information to consumers. Costco has not admitted any wrongdoing, and the allegations have not been proven in court. Orgain has stated that its products comply with applicable food safety standards.
The lawsuit seeks to represent consumers in several states who purchased the affected Orgain protein powder products from Costco during the applicable class period. Plaintiffs are seeking damages, restitution, and injunctive relief, including changes to Costco’s marketing and product disclosures.
