A lawsuit has been filed against Unilever United States and The LIV Group, alleging that they falsely advertised their Liquid I.V. Hydration Multiplier electrolyte drink mix products as “sugar-free.” According to the complaint, these products were labeled as having “zero sugar” despite containing allulose, a type of sugar.
The lawsuit claims that the labeling on Liquid I.V. products is misleading because it suggests the drinks are sugar-free, while in reality, they contain four grams of sugar per serving. This amount is significantly higher than the less than 0.5 grams of sugar allowed by federal and California law for products labeled as “sugar-free.” The complaint references a ruling by the U.S. Court of Appeals for the Seventh Circuit, which classifies allulose as a sugar under federal regulations.
Plaintiffs argue that consumers were harmed by paying a premium for a product they believed to be sugar-free. They claim that the misleading labeling gave Unilever and LIV an unfair competitive advantage, as consumers seeking sugar-free options may have chosen these products over others based on the false representation.
The complaint seeks to represent a class of consumers who purchased Liquid I.V. Hydration Multiplier products in the past four years. Plaintiffs are requesting damages, restitution, disgorgement, injunctive relief, and punitive damages, among other forms of relief.
