Ken Foods Salad Dressing False Advertising Class Action Lawsuit

A new class-action lawsuit has been filed against Ken’s Foods, accusing the company of falsely advertising its Simply Vinaigrette Italian dressing as free from artificial preservatives.


According to the complaint, the product is labeled with the claim “no artificial preservatives,” yet contains xanthan gum, which the plaintiff argues is a synthetic ingredient that acts as a preservative. The lawsuit describes xanthan gum as an “industrial additive” made through bacterial fermentation using sugars such as glucose, sucrose, or lactose.


The plaintiff seeks to represent a class of consumers who purchased the dressing for personal use within the applicable statute of limitations. They argue the product is misbranded because xanthan gum is classified by regulatory agencies as a synthetic or non-natural substance, and is commonly recognized in the food industry for extending shelf life.


The lawsuit claims Ken’s Foods violated New York’s General Business Law and demands a jury trial, along with actual damages for the plaintiff and other affected consumers.
