ESPN Privacy Law Class Action Lawsuit

A new lawsuit alleges that The Walt Disney Company’s ESPN website violated federal privacy law by tracking and collecting users’ sensitive browsing information without proper consent. According to the complaint, ESPN’s online platform disseminated data to third-party analytics and advertising companies even when visitors were not logged in or had attempted to opt out of tracking.

The lawsuit claims that this practice runs afoul of the Video Privacy Protection Act (VPPA), a federal statute that prohibits certain disclosures of users’ video-watching habits and other online activity. Plaintiffs argue that ESPN’s data collection and sharing occurred without clear, informed consent, and that users’ personal information was improperly exposed to third parties.

Plaintiffs seek to represent a nationwide class of ESPN website users whose data may have been collected and disseminated in this way. The complaint requests statutory damages, injunctive relief to stop further alleged violations, and legal fees.
