Family Dollar Lawsuit Alleges OTC Products Illegal, Unsafe, Defective

Family Dollar sold over-the-counter products that were allegedly stored at improper temperatures, rendering them unsuitable for sale.

It is alleged that the retailer sold over-the-counter drugs, medical devices and other products that were rendered unsafe for human use because they were improperly stored.

A recent investigation claims that Family Dollar stored its over-the-counter products in extreme temperatures that fail to meet the labeled temperature requirements. As a result, the Family Dollar OTC products did not meet safety, strength, quality, purity and effectiveness requirements and should not have been sold to consumers, as plaintiffs allege.

Investigations point to a 2022 inspection report by the U.S. Food and Drug Administration that described the “deplorable conditions it observed” in Family Dollar stores, including rodent infestation and improper storage of drugs.
